5-6 有住房性能评估证书的住房
「拥有住房性能评估证书的住房 」是由《促进住房质量保障法》规定,根据「住房性能表示制度」由第三方对房屋性能出具评估证书的房屋。
让我们了解一下这个制度的益处。

要点1 什么是住宅性能表示制度
新建住房的住房性能表示制度于2000年开始实施。这包括10个方面的33个项目,如结构稳定性、减轻恶化、维护管理和更新、温热环境和能源消耗等。*关于新建住宅的性能,由国土交通大臣登录的第三方机构「登录住宅性能评估机构」给予1~5等级的评估制度。因而提供对房屋的客观性能评估。
该制度属于任意制度,并非所有的房屋都要进行性能评估。 而且,任何人都可以申请住房性能评估,包括建造房屋的建筑公司、房屋的买家或卖家。
*新建住宅的性能评价分2种
性能评估有两种类型:一是设计房屋性能评价,总结设计图面的评估结果;二是施工房屋性能评价,对经过设计房屋性能评价的房屋,在施工和竣工时进行现场检查和核查施工记录文件的结果。
*现有住房也在评价制度的范围之内
从2002年8月开始启动了现有住房(二手房)评价制度。在对现有住房的评价中,除对新建住宅制定的9组28个评价项目外,还有2个项目只针对现有住房。对当前状态检查所确认的恶化和其他情况的评价是强制性的,而住居的个别性能的评价是可选的。
要点2 拥有住宅性能评估证书住房的特征
拥有住宅性能评估证书的房屋有很多优势。
(1)由国土交通大臣登录的第三方机构提供客观的住房性能评估。
(2)新房住宅,如果卖方作为住房供应商,在销售合同中附上住房性能评级或其副本,或向买方交付住房性能评级或其副本,则合同被视为规定交付具有评估证书上所示性能的房屋。因此,如果评估报告中指出的性能没有达到,买方可以要求作为卖方的房地产公司进行维修工作,赔偿损失等。
(3)取得建筑房屋性能等级证书可以根据抗震性能等级享受地震保险费率的优惠。
(4)抵押贷款利率可能有优惠。
要点3 根据住宅性能表示制度处理住房纠纷
如果持有建筑用房性能评估证书的房屋发生住房问题、房屋的合同或销售协议有争议,可以向国土交通大臣指定的「指定住宅纠纷处理机构」申请解决争议。纠纷处理手续费是1件大概一万日元。
*指定的住房纠纷处理机构是促进和加快处理住房纠纷的机构。
