要点1 房地产业务和房地产交易业务的区别
房地产业务和房地产交易业务并不是同义词。房地产行业包括各种类型的业务,如买卖、经纪(也称为 "中介")、租赁(土地、房屋和建筑物的业主)和管理(公寓的管理、租赁物业的管理等)。 另一方面,房地产交易业务只包括房地产业务中那些处理交易(分销)的部门,如买卖和经纪。 因此,在出售或购买房屋时,有必要了解房地产交易业务。
要点2 房地产交易业务
(1) 自己进行的建筑土地和建筑物的买卖和交换
(2) 买卖、交换或借贷时的代理或中介业务。
*根据《建筑土地和建筑物交易法》的规定,房产交易公司必须取得国土交通大臣或都道府县知事签发的营业许可。许可证的签发是由公司事务所的设置所定。 房地产交易许可证的有效期为5年。
需要注意的是,虽然房产交易包括按房主的要求为房产提供租赁中介服务(如招聘租户),但不包括自己出租(如管理出租楼房或公寓),也不受《房地产交易业务条例》的监管。

此外,如果房地产交易公司违反法律,许可机构将发出行政处罚,如指示改善业务、暂停业务或撤销许可证。 然而,不可能仅根据这些情况来判断,这些只能作为参考。
要点3 房地产交易经纪人
房地产交易经纪人是在已通过国家资格考试后,向许可机构登录,取得房产经纪人的认证证书,是掌握房产交易知识的专家。无论在房地产交易法中还是在不动产交易中都是特别重要的业务,房产和契约内容等的说明(重要事项说明)和说明书和契约书页面的签字、盖章,都规定必须由房地产交易经纪人执行。
不动产公司如果要取得营业许可证,必须要有房产交易经纪人在籍。
